Request

1. How many sexual safety incidents has the trust recorded where the alleged victim was a patient aged 60 or over and the alleged perpetrator was a staff member (including agency staff)?

Under section 40 (2) of the Freedom of Information Act 2000, a public authority does not have to provide information where that information is considered personal information under the Data Protection Act 2018. We believe that, because of the low number of patients involved and the potential for them to be identified when combined with other available information, the information you have requested falls into this category, and therefore will not be supplying this as a result. The actual figure has been replaced with <5.
 

2. Do you have a Sexual Safety policy in place that covers assaults on patients by staff?

CLCH has a number of policies in place, including:

  1. Managing Allegations Against CLCH Staff Policy, which would include the reporting and management of alleged assaults on patients by staff.
  2. Safeguarding Children and Young People Policy and a Safeguarding Adults at Risk Policy which staff are required to follow. The policy includes what actions staff need to take if/when a safeguarding concern is raised about any alleged physical or sexual assault, perpetrated by a member of staff or a member of the public.
  3. The CLCH Intimate Care and Chaperoning Guidance is in place to safeguard the position of patients and staff throughout consultation, examination, treatment and care and specifically references sexual abuse.

CLCH is signed up to the NHS England Sexual Safety Charter (2023) and the Trust is in the process of ratifying a Sexual Safety Policy, in line with the NHS England Framework which will look at the safety of both staff and patients.

 

3. Does the policy also explicitly address the sexual abuse of older people?

The Safeguarding Adults at Risk includes the need to involve police and follow Human Resources Policies when there is an allegation against a CLCH staff member, including an allegation of sexual abuse.
 

4. Have staff received training on dealing with sexual abuse against people with dementia?

No
 

5. What training have staff received on dealing with sexual abuse against people with dementia?

All CLCH staff undertake mandatory safeguarding training, which includes sexual abuse and managing allegations against CLCH staff.

There is currently no specific sexual abuse against older people with dementia training, but this is being addressed in light of the Sexual Safety Charter and the ratification of the CLCH Sexual Safety Policy this year
